Instructed by DAC Beachcroft, James Arney recently negotiated a settlement of £1 million gross on behalf of his insurer client.
The claimant was the sole survivor of a car crash which claimed the lives of three others. Though the claimant made a remarkable recovery from his injuries, his claim amounted to nearly £3.7 million at the time of the settlement meeting, and included significant claims for accommodation, care and adaptations.
The prospect of a review of the discount rate, as well as a realistic approach to the impact of future treatment on the claimant’s ability, guided the negotiation to a satisfactory settlement at 27% of the pleaded value.
