Rodney Dixon KC acted for the Government of the Comoros before the ICC in a judicial review application of the Prosecutor’s decision not to open an investigation into the Israeli Defence Forces (IDF) operation against the Mavi Marmara on the high seas in the Mediterranean in May 2010 when the Gaza Flotilla was intercepted.
It resulted in the deaths of 10 passengers and over 50 persons were injured. The Prosecutor was previously ordered by the Chamber to reconsider her decision, and following a review, she reached the same decision. A second judicial review application was thus submitted by the Comoros (a State Party of the ICC under whose flag the Mavi Marmara was sailing) and over 300 passengers, represented by Rodney Dixon KC (instructed by Stoke & White Ltd, London). In light of the extensive delays in this case, the Chamber has given the Prosecutor a fixed period of 6 months until May 2019 to reconsider her decision.
