Simon Browne QC and Ben Casey secured the High Court’s approval of a £1.85m settlement in favour of a young woman who was struck on the head by the wing mirror of a speeding mini-bus as she stepped off the kerb.  The claimant lacked capacity as a result of the serious head injuries sustained.

Liability remained in dispute throughout with significant contributory negligence alleged in the alternative.

The case involved difficult issues concerning whether the accident would have been avoidable at a non-negligent speed, the extent to which the injuries would have been lessened at a non-negligent speed and the quantification of numerous heads of loss including lifelong care and support packages.
