Landmark judgment finds British-born children of EU nationals are not British citizens

09/02/2023

The High Court today handed down a landmark judgment refusing a judicial review claim arguing that EU citizens exercising Treaty rights in the UK were “settled” for the purposes of the British Nationality Act 1981.  As a result, as a matter of law UK-born children of EU nationals are not and have never been British citizens from birth, despite in many cases being officially recognised as such.
