Kathryn Howarth secures the discharge from extradition proceedings of a mother of two young children, in relation to an extradition request from the Czech Republic

20/06/2023

On 15 June 2023, Kathryn Howarth secured the discharge from extradition proceedings of a mother of two young children, in relation to an extradition request from the Czech Republic. The case was heard by District Judge Girffiths at Westminster Magistrates’ Court and Kathryn was instructed by Chris Stevens of Sonn Macmillan Walker solicitors.

The extradition of both mother and father had been sought by the Czech Republic in relation to different offences, for which they had been separately tried, convicted and sentenced. If extradited Ms Sarayova (whom Ms Howarth represented) would have faced a prison sentence of approximately 2 ½ years and her two young sons would have faced an uncertain future. District Judge Griffiths found that it was in the ‘best interests’ of the children for them to remain in the care of at least one parent and ruled that Ms Sarayova should be discharged from the extant proceedings.
