Kathryn Howarth, instructed by Natalia Cichosz, achieved the discharge from extradition proceedings on Article 8 ECHR grounds of a Requested Person whose surrender had been sought by Poland to serve 3 years imprisonment.

04/07/2023

Kathryn Howarth represented the Requested Person at his extradition hearing before District Judge Turnock on 16 June 2023, who on 4 July 2023 handed down a judgment discharging the Requested Person from the extradition proceedings at Westminster Magistrates’ Court. He was discharged on the basis of Article 8 ECHR with the judge finding that the personal cirucumstances of the Requested Person and the likely impact that extradition would have on his family (his partner and three children) together with lengthy and culpable delay tipped the balance against ordering his extradition. The Requested Person was represented by Kathryn Howarth at the extradition hearing and also by Saoirse Townshend in preapring the case and instructing expert witnesses. Natalia Cichosz of Lawrence & Co was the instructing solicitor.
