Benjamin Seifert and Saoirse Townshend successfully represent vulnerable epileptic man suffering from PTSD

On 22 September 2023, District Judge Rai, sitting at Westminster Magistrates’ Court discharged a Romanian man.

He had been arrested on a Part 1 Warrant for stealing copper from an from an electrical system and then, a number of items from an unlocked warehouse. The offences dated back to 2012 and 2017.

The challenge to extradition was on the basis of Articles 3 and 8 of the European Convention on Human Rights as well as Section 25 of the Extradition Act.

The case concerned the seriousness of the offending. The copper was valued at £58.11 and the building products stolen in the first offence to the sum of £587.65. He had been sentenced to a term of 5 years. Arrested on the warrant on 30 December 2021 and was held in custody until the extradition hearing on 13 June 2023. Having heard the extensive evidence from Dr Juliet Cohen concerning his epilepsy and PTSD the judge released Mr Driga on conditional bail before giving her decision to discharge him on 22 September 2023. Benjamin and Saoirse were instructed by Katy Smart and Enrico Braguglia of Sonn Macmillan Walker.
