As reported by the Associated Press, Rodney Dixon KC was instructed to give an Opinion on the compatibility with international human rights law of the first-instance criminal proceedings against Mr Raffaele Mincione in the Tribunal of the Vatican City State. Those proceedings have been popularly dubbed ‘the Vatican’s trial of the century’.
The reporting reflects that the Opinion concluded that the proceedings were ‘marred by substantial violations of well-established international legal obligations applicable to all criminal proceedings’. The Opinion is based, in particular, on an analysis of customary international human rights law, which binds the Holy See as it has international legal personality and is a subject of public international law. The Holy See is responsible for the acts of its organs, such as the Office of the Promoter of Justice of the Vatican City State and the Tribunal itself.
Mr Mincione is appealing against his conviction by the Tribunal.
