Russell Hopkins and Anisa Kassamali appear before High Court in respect of BHP’s alleged liability for Brazil’s worst environmental disaster

The collapse of the Fundão Dam in November 2015 has been described as the worst environmental disaster in Brazil’s history. It is alleged that BHP is responsible for that collapse.

Following a case management conference on 18 April 2024, Mrs Justice O’Farrell directed that BHP hand over numerous documents which should assist the claimants’ case, including the employment contracts, key performance indicators and performance evaluations of key BHP individuals.

It is said that these documents will assist the claimants in establishing BHP’s liability for the collapse. That will be decided during a trial starting on 7 October 2024, in which Russell Hopkins and Anisa Kassamali of TGC will appear on behalf of the claimants.
