Strike out successfully resisted on behalf of thousands alleged to have suffered as a result of the collapse of the Fundão Dam

Anisa Kassamali, together with Dan Oudkerk KC of Essex Court Chambers and Mark Friston of Hailsham Chambers, successfully resisted a strike out application on behalf of thousands of individuals who allegedly suffered as a result of the collapse of the Fundão Dam in November 2015.

The collapse has been described as the worst environmental disaster in Brazil’s history. It is alleged that BHP is responsible for that collapse.

BHP sought to strike out on various bases the claims of thousands of claimants who allegedly suffered as a result of the collapse. Mr Justice Waksman considered that application over two days and ruled largely in the claimants’ favour.

The issues relevant to those claimants will be decided during a trial starting in October 2024, in which Russell Hopkins and Anisa Kassamali will appear on behalf of the claimants.
