Saoirse Townshend successfully resists the Government of Turkey’s appeal against a requested person’s extradition concerning Article 3 ECHR and prison conditions

Saoirse Townshend, instructed by SMW Law successfully resists the Government of Turkey’s appeal against a requested person’s extradition before a Divisional Court in the lead case concerning Article 3 ECHR and prison conditions.

Dingemans LJ and Stacey J handed down judgment yesterday in The Government of Türkiye v Demir & Others [2024] EWHC 2351 (Admin). The Court upheld DJ Heptonstall’s order to discharge Mr Demir on the grounds that the offence was not an extradition offence, as the conduct did not amount to a criminal offence in the UK.
