Russell Hopkins and Anisa Kassamali are instructed by Pogust Goodhead in what is likely to be the largest ever group action brought in the English Courts: Municipio de Mariana and others v BHP Group. Russell and Anisa are led by Alain Choo Choy KC of One Essex Court and Andrew Fulton KC of Twenty Essex, together with Nicholas Harrison (Serle Court), Jonathan McDonagh (Serle Court), Ibar McCarthy (Normanton Chambers), Grace Ferrier (Essex Court Chambers), Antonia Eklund (Blackstone Chambers) and Hannah Taylor (Cornerstone Chambers). The case is one of The Lawyer’s Top 20 cases for 2024.
The claim is brought by c.620,000 Claimants against the mining company in respect of the collapse of Brazil’s Fundão Dam in November 2015. The consequences have been widely reported: https://www.theguardian.com/world/2024/oct/13/bhp-to-face-620000-claimants-in-mariana-dam-collapse-trial-in-london.
The first stage trial starts today (21 October 2024) and is listed to run until 7 March 2025.
