Discharge of unprecedented super-injunction

Chamberlain J today discharged a contra mundum super-injunction that was granted to the Ministry of Defence on 1 September 2023: Ministry of Defence v Global Media and Entertainment Limited and others [2025] EWHC 1806 (Admin).

That super-injunction prevented publication of the fact that a dataset containing personal information and contact details of individuals applying for relocation to the UK from Afghanistan following the Taliban’s takeover in 2021 had been released. The super-injunction also prevented disclosure of the fact of the injunction itself. Various media organisations that learned of the release of the dataset were served with injunction.

The reason for the super-injunction was due to the assessment that disclosure would expose individuals to risk at the hands of the Taliban. This was balanced against concerns including the freedom of the press and national security.

The Secretary of State for Defence today made a statement to Parliament following the discharge of the super-injunction. The story has been covered in the media extensively, including by those organisations which were parties to the injunction proceedings.
