Judgment handed down by the High Court in Al Haq v Secretary of State for Business and Trade

On 30 June 2025, the High Court handed down judgment in Al Haq v Secretary of State for Business Trade.

Kathryn Howarth acted for the Defendant, in a team led by Sir James Eadie KC.

The High Court dismissed the Claimant’s challenge to a decision made by the Secretary of State for Business and Trade to suspend licences authorising the export of items that might be used in carrying out or facilitating Israeli military operations in the conflict of Gaza, which excluded from the suspension licences for the export of components for F-35 combat aircraft which could not be identified as destined for Israel.

The case raised a variety of public law and public international law issues. These included international trade law, international humanitarian law and international criminal law.
