Keith Morton KC secures acquittal of national highways contractor on all charges

An employee of Ringway Infrastructure Services Limited, working as a member of an Emergency Stand-by Crew, was killed by a drug-driver while responding to a reported hazard on a high-speed dual carriageway in Hertfordshire. The driver pleaded guilty to various offences including causing death by careless driving when over the specified limit for various drugs. The Health and Safety Executive (HSE) then alleged that Ringway had failed on and before the date of the fatality to make reasonably practicable arrangements to ensure the safety of its employees and non-employees (road users) when responding to emergencies on high-speed dual carriageways throughout Hertfordshire. After a 14 day trial at St Albans Crown Court the jury unanimously acquitted Ringway.

This follows earlier proceedings in which Keith represented Ringway in it is appeal to the Employment Tribunal against an Improvement Notice issued by the HSE arising out of the same incident. The appeal was successful and the Improvement Notice was cancelled (for press reports see for example https://www.constructionnews.co.uk/health-and-safety/ringway-wins-appeal-against-hse-risk-assessment-notice-02-10-2024/). The HSE has lodged an appeal to the High Court against that decision, which is listed for hearing in October 2025.
