Mat Brunning represented the Claimant, a plant operator who was hit by a speeding vehicle being chased by the police. Constructive dialogue with the MIB allowed the Claimant to trial and obtain suitable prosthetics relatively rapidly post-accident, such that the Claimant was able to achieve his pre-accident aim of becoming self-employed, increasing his income from pre-accident; and returned to keeping sheep on a smallholding in his spare time.
The issues in the case were the extent to which costs of heavier machinery and greater use of sub-contractors were accident-related; which, and how many, prostheses the Claimant would require, both for work and his leisure activities; the extent to which he would want or need to be capable of the heavier aspects of work himself, as his business grew and as he aged; and the amount of support he would require, both immediately and in later life.
The settlement was on the basis of an immediate move to suitably adapted, single storey, accommodation.
