David R White has secured exemplary damages for his client, an insurer who was the victim of orchestrated and repeated fraudulent credit hire claims by a rogue accident management company.
Importantly, the Judge agreed that Judgment should be entered against the sole director of the company personally, as he had used it as a tool to orchestrate ‘sustained’ fraud by fabricating alleged hire provisions that never in fact occurred. At times, the company was claiming in respect of the same vehicle multiple times in overlapping periods from several different insurers.
The court decided that, in addition to the compensatory damages to recover outlay, it ought to make a punitive award of exemplary damages in order to condemn the Defendants’ acts, and send a message to other potential fraudsters.
