Anthony Johnson Establishes Liability in Respect of Attack on Cleaner by Hospital Patient

A reserved Judgment was handed down on 06.05.26 following a three-day Multi-Track trial in this case where liability, factual and legal causation and quantum had been strongly disputed throughout.
 
Anthony Johnson represented the Claimant who was employed by an agency to clean on a Ward at the Defendant’s Hospital. She was attacked by a vulnerable patient who was known to become violent when agitated. Recorder Brander accepted the Claimant’s case that the Defendant had been negligent in failing to immediately order the Claimant to leave the vicinity when the patient approached her.
 
Bringing the case to trial required the navigation of a number of difficult challenges including a language barrier, significant disputes of fact, an application in relation to the disclosure of documents that were not initially provided and an extensive dispute in relation to medical evidence.
