The Court of Appeal has handed down judgment in Wetherell v Student Loans Company, holding that the Work Equipment Directive provided state employees with directly effective rights capable of vindication through a civil damages claim, notwithstanding the statutory ouster of civil liability in s.47 Health and Safety at Work Act 1974. The issue had been raised as a preliminary issue below, and the case will be remitted for trial.
