Dominic Adamson KC, together with Mike Atkins of Crown Office Chambers, instructed by Mamata Dutta and Andrew Martin of RPC, successfully represented Foster + Partners in a five-week trial for an alleged breach of the Health and Safety at Work etc Act 1974 at Inner London Crown Court.
The prosecution arose from the tragic death of a member of the public in 2018 when a penthouse vent (which is a type of openable window) fell from the 26th floor of a high-rise residential development on London’s Albert Embankment. Foster + Partners was the architect and lead consultant for the development. The HSE alleged that it had breached s.3 of the Health & Safety Work etc Act 1974 in relation to the design of the penthouse vent system.
The trial involved detailed expert and factual evidence concerning the design, manufacture and installation of the window, together with the examination of the roles and responsibilities of various organisations involved in the construction project. It raised issues regarding the scope of the designer duty under both the 2007 and 2015 Construction (Design and Management) Regulations as well as the Health and Safety at Work etc. Act 1974. It also involved examination of the respective roles and responsibilities of an architect, a façade engineer, a façade design and build contractor and a principal contractor and designer in a complex project such as the Corniche.
Following a five-week trial, the jury acquitted Foster + Partners.
