 Substantial six figure settlement of a hard-fought claim involving an assault on a primary school PA to the headteacher by a 9-year-old pupil.

C sustained soft tissue injuries to her left wrist and right shoulder whilst attempting to restrain a violent pupil.   The injuries evolved into a chronic pain presentation diagnosed by her experts as CRPS in one limb and Chronic Primary Pain in the other with overlying secondary Somatic Symptom Disorder with symptoms of depression and anxiety.  

She became increasingly disabled by the pain and had a spinal cord stimulator (SCS) fitted. She developed subsequent complications injuring her spinal cord when the SCS paddles were relocated under general anaesthetic.  

Breach of duty was originally conceded through the PI Portal when it appeared to be a low value claim. Subsequently, D was permitted to resile from the admission.   Liability became acutely contested. C’s credibility was openly challenged by D’s pain expert. Potential differential diagnoses to CRPS were advanced by D to include an exacerbation of a pre-existing SSD whilst floating the possibility of her presenting with a Functional Neurological Disorder.  

The case settled shortly before an 8-day High Court trial
