Ellen acted for the family of the deceased, who had passed away after falling backwards on a chair in a Wetherspoons pub. There was an evidential issue as to whether the CCTV evidence showed another individual, who gave evidence at the inquest and denied the allegation, had pushed the deceased.
The inquest also addressed complex cardiac pathological evidence regarding the medical cause of death. The Coroner adopted Ellen’s suggested approach of hearing evidence from both a pathologist and a consultant in emergency medicine at the same time (“hot-tubbing”) – an unusual approach which he considered was justified given the complexity of the evidence.
The inquest also considered delays in the emergency response service and upheld the family’s submission that errors made by the 999 call handler had materially contributed to the death. The Coroner also made a Regulation 28 report at the family’s request regarding the lack of CPR training among Wetherspoons staff.
