The Claimant (C) was an 11-year-old schoolboy at date of accident and 22 years old at trial, who sustained significant injuries.   He alighted from a bus outside school and, being slightly late and in a rush, attempted to cross the road whereupon he was struck by D’s car.   D was familiar with the road, the presence of two schools and bus stops were numerous children alighted.  D had seen C but had not been able to stop in time.

Peter Freeman successfully represented D.   The Judge, Mr Rec. Kohli, found that there was no evidence that D had been negligent in relation to his speed, his observations, his reaction or his braking.    Claim dismissed.
