Seven figure settlement of a TBI case where Fundamental Dishonesty was alleged.

C sustained a TBI in an unpleasant RTA at the age of 22. She was treated as though she had sustained a severe TBI and admitted for 9 months into a residential head injury unit where she made progress.

Her treatment there was terminated early when D’s experts suggested that such treatment was contraindicated because she had suffered no more than a mild TBI and had gone on to make a good recovery from her overlap orthopaedic injuries.

Heated litigation ensued. Covert surveillance over 62 days was served. An exhaustive trawl through 8 years of bank statements and social media resulted.

Expert evidence from 12 clinical disciplines was served involving numerous rounds of reports over the 9 years of the litigation.

D served a 199-page counter-schedule and the case settled 6 weeks before a 12 day trial through mediation.
