Saoirse was instructed on behalf of the SSHD. Linden J allowed the Claimant’s judicial review of the SSHD’s decision to defer extradition to Portugal in favour of the US (s.179(2) Extradition Act 2003). This is the first judicial review which challenged a decision under s.179. The Court expressly permitted both representations from the requested person to the SSHD and the person’s “interests” to be considered. The SSHD has appealed the decision to the Supreme Court and Court of Appeal. There is a complex and novel jurisdictional issue as to whether this matter is a “criminal cause or matter” and therefore which is the appropriate venue for an appeal.
