An 18 year old woman had her stomach removed in emergency surgery hours after consuming a drink accompanied by a ‘smoke effect’ made using liquid nitrogen. The bar was prosecuted under the Health & Safety at Work Act 1974 and was heavily fined.
The director of the defendant company was also prosecuted individually, but Kevin was able to negotiate a plea bargain in which the case against the individual was dropped, thus avoiding the possibility of a prison sentence.
The case attracted huge media interest from as far afield as Canada and Australia, in view of the grievous injury sustained by a young woman and the implications for the drinks industry worldwide.
