 £450,000 settlement of a chronic pain case involving a laboratory assistant who developed non-specific chronic back pain when exposed to an unsafe system of occupational lifting. C developed low back pain after being required to engage in prolonged moderate lifting tasks. She suffered episodic flare ups of the back pain initially; the system of work was not adjusted.  

After the third flareup over nine months, during which ability to achieve sleep was impacted adversely, she developed more widespread chronic pain, formally diagnosed as Chronic Primly Musculoskeletal Pain.  

That impacted on her ability to work and function effectively in activities of daily living. Her mood levels dropped to the point where she was diagnosed as suffering a Moderately Severe Major Depressive Disorder.  

Over the passage of time, her presentation evolved to the point where she met the diagnosis of Somatic Symptom Disorder With Predominant Pain.   She brought a claim for lost earnings and some domestic assistance at home.  

The claim was met with disbelief and indifference. Less than £6000 was conceded in a Counter Schedule served by the Defendant.  

The settlement was achieved through negotiation against the backdrop of impending litigation.
