£1.025m settlement for a 55-year-old manager sustaining a concussion to her vestibular system.

C sustained damage to the otolith organs in her left inner ear following a concussive head injury sustained in a high energy rear end shunting accident.

She developed a migrainous post-concussion syndrome, causing her a cluster of typical post-concussion symptoms leaving her with a reduced cognitive reserve to cope with the demands of her high functioning job.

She managed to buffer those symptoms suffering a minimal loss of earnings for 35 months after the accident before leaving that job to mitigate her loss of earnings with part time less demanding work.

The Defendant’s experts acknowledged much of the medicine underpinning the claim, save for the prognosis of the enduring vestibular symptoms, which they contended were amenable to further treatment.

The case settled through negotiation.
