W v MIB 3

30/11/2022

Citation
(Unrep) - 30.11.22

£1.8m settlement from the MIB under the Untraced Driver’s Agreement for a scaffolder who sustained career-ending leg injuries in a motorcycle accident.

This 27-year-old scaffolder sustained bony and soft tissue injuries, extending down his left leg together with psychological injuries in a hit-and-run motorcycle accident.

He needed to undergo surgery which revealed partial tears to his ACL and MCL and left him with a significant footdrop and enduring neuropathic pain.

What took his case out of the norm was that he was running a scaffolding company with his father before the accident. On his case he was the driving force in upscaling the company and its profitability.

He instructed his legal team to commission forensic accountancy evidence to demonstrate a lost chance of supplementing his earning capacity as a scaffolder with significant earnings as a director of a successful scaffolding business.

It was that element of the claim that resulted in a seven-figure settlement.
