Instructed on behalf of the Ministry of Justice in respect of a claim brought pursuant to the Human Rights Act 1998 in the High Court, Queen’s Bench Division.

The Claimant alleged that the Defendant, through the actions of the Sheffield County Court staff and the Judges making decisions on her case had breached her Article 6 and 14 rights under the ECHR and/or was negligent. The Claimant sought damages in excess of £1,800,000.

The claims, raising questions of immunity from suit under the Crown Proceedings Act 1947, were struck out by the High Court on the basis that they had no real prospect of success.

The Claimant’s application for permission to appeal was dismissed at a contested oral hearing.
