Shajahan & Others v Addr & Churchill


Edward Hutchin, instructed  by Eli Wieder of Keoghs, represented the successful Defendant insurer in this case in which 2 Claimants were claiming damages following an alleged road traffic accident in Birmingham. The Defendant driver did not cooperate with his insurers, but the claim was defended on the basis that the Claimants’ evidence about the accident could not be believed, and that they were part of a fraudulent scheme to make false compensation claims. After a 4 day trial the judge dismissed the claims, finding that they were fraudulent. The Claimants were ordered to pay the Defendant insurer’s costs of defending their claims on an indemnity basis.
