ICC Appeals Chamber orders ICC Prosecutor to reconsider Gaza Flotilla case

Following hearings before the Appeals Chamber, it has ordered the ICC Prosecutor to address the errors of law and fact in her decision not to proceed with an investigation into the war crimes allegedly committed during the raid on the Gaza Flotilla on the high seas in May 2010, as found by the Pre-Trial Chamber below.

Rodney Dixon QC initiated the judicial review proceedings of the Prosecutor’s decision on behalf of the Government of the Union of the Comoros, an ICC State Party on whose vessel the attack took place and who referred the case to the ICC. The Prosecutor is required to reconsider her decision by 2 December 2019. This is the first ruling by the ICC Appeals Chamber on the scope of judicial review proceedings before the ICC.
