Substantial Damages Approved by HighCourt following the death of a Soldier suffering from PTSD

1st August 2022

Paul Kilcoyne was instructed by Victoria Beel of Slater and Gordon on behalf of the family of soldier X who hanged himself whilst in the care of the West Park Hospital, Darlington.

Soldier X had been suffering from depression and PTSD and was admitted to  West Park Hospital on 16th March 2015. He was suicidal on admission and placed on close supervision. His condition improved and the supervision became intermittent. On the evening of the 21st March 2015 Soldier X was found hanging from a noose made out of a belt which was attached to a door.

The case ultimately did not criticize the clinical decision to alter the supervision but the failure to carry out a ligature point assessment . An earlier assessment by the hospital had identified the door in question as a potential ligature point risk. The case settled at a JSM for a significant six figure sum and was ultimately approved in the Manchester District Registry.
