Temple Garden Chambers undertakes a broad range of professional negligence claims, including clinical negligence, acting for both claimants and defendant insurers.

Our work incorporates a wide variety of disputes, including claims involving accountants, insurance brokers, medical professionals, barristers, solicitors and surveyors.

The nature of this work varies from simple claims for and against solicitors in respect of missed limitation or procedural deadlines to complex claims involving reviews of lengthy litigation which include failures to properly advise the clients or to follow the client’s instructions. Claims against barristers have included failures to draft Particulars of Claim that disclose no reasonable cause of action or to take points that would have resulted in a lost case being won. A clinical negligence claim might involve the failure of a medical practitioner to correctly diagnose a condition such as cancer or to remove the cancer at mammectomy.

We deal with claims against surveyors for valuing property too high or too low, accountants for failing to detect fraud within a company or to properly advise on the tax implications of a transaction and against insurance brokers for failing to provide a client with the correct type of insurance.

Our cases often involve difficult issues surrounding the scope of the duty of care owed (e.g. whether solicitors owe a duty of care to funders), causation and the quantum of damages.

Members of chambers have been involved in some of the seminal cases on causation when assessing a loss of a chance (Perry v Raleys Solicitors [2019] UKSC 5) and the scope of a solicitor’s duty of care (Thomas v Hugh James [2017] EWCA Civ 1303). We have strength in depth and are able handle all types of claim, both at first instance and on appeal, from multi-million pound litigation in the High Court to bottom-end multi-track in the County Court. We pride ourselves in being client focused and able to cut through to the core issues in a case.
