Andrew Ratomski joined Chambers as a tenant in 2024 after completing pupillage under the supervision of Piers Taylor, Joanna Hughes and William Irwin.
He is developing a mixed practice across the full spectrum of Chambers’ specialties with a focus on personal injury and civil litigation, extradition and public law. Andrew has a busy court-based practice and is regularly instructed by claimants and defendants in trials on the Fast Track and Small Claims Track, contested applications, Stage 3/OIC hearings and infant approval hearings. He is also familiar with the full range of issues that arise in credit hire litigation and has been instructed by both insurers and claimants. In addition Andrew is developing a paperwork practice across all of Chambers’ core areas and also co-edits the Personal Injury Brief Update monthly newsletter (https://www.pibriefupdate.com/content/latest-issue).
Andrew is a member of the Attorney General’s Junior junior scheme and is currently instructed by the Commissioner of the British Indian Ocean Territory (led by John McKendrick KC and William Irwin).
Before starting pupillage, Andrew worked as a paralegal in the legal team of UK Government Investments where he assisted with a major public inquiry. Andrew also spent a year as the Judicial Assistant to the Rt Hon Lord Justice Singh in the Court of Appeal (2021-2022) where he assisted with matters spanning public law, immigration, EU law, personal injury, employment and criminal law. He also assisted with hearings in the Administrative Court and in the Investigatory Powers Tribunal. Whilst a law student, Andrew volunteered with Liberty’s Advice and Information service.
Prior to coming to the Bar Andrew worked overseas as a management consultant with global firm Innosight.
Outside of work, Andrew enjoys spending time in the mountains hiking, climbing and skiing but sticks to running and cycling in London.
During pupillage Andrew was supervised by Piers Taylor and Joanna Hughes and also undertook work on behalf of Peter Freeman and Tim Sharpe.
Andrew appears regularly in the County Court for claimants and defendants. Recent highlights of Andrew’s personal injury practice include:
· successfully resisting an application to strike out a five figure personal injury claim as an abuse of process;
· being instructed to represent a claimant in a strike out application raising questions of res judicata,
· representing a claimant at a Stage 3 hearing with complex causation issues and medical reports in several specialties, and
· several claims on behalf of claimants where complex acceleration injuries have been caused by road traffic accidents, or causation issues have been raised as to the degree of underlying degenerative change and the impact of pre-existing conditions.
Andrew has also been instructed to provide advice on quantum and on the merits of public liability claims.
During pupillage, Andrew gained experience in the full spectrum of personal injury litigation arising from road traffic accidents, claims against occupiers and contractors, under the Highways Act 1980 and where allegations of fraud or fundamental dishonesty were raised. Andrew also assisted with numerous advices on general damages in complex injury cases and in settling Schedules and Counter-schedules.
During pupillage Andrew also assisted a senior member of Chambers with research on the substantial injustice exception to a finding of fundamental dishonesty under section 57 of the Criminal Justice and Courts Act 2015.
Andrew is developing an extradition practice and has acted on behalf of Requested Persons in hearings in Westminster Magistrates’ Court. During pupillage Andrew gained further experience of international criminal law during a week observing proceedings at the Kosovo Specialist Chambers.
Andrew was supervised during pupillage by William Irwin. Andrew gained exposure to a range of public law matters including immigration, prison law, civil claims against public authorities and in the ongoing BIOT litigation.
He is familiar with all aspects of judicial review procedure. Andrew also gained experience of several high-profile judicial review claims in the Administrative Court and the Court of Appeal as a Judicial Assistant to the Rt Hon Lord Justice Singh.
Andrew accepts instructions in both inquests and inquiries. During pupillage Andrew attended a number of inquests including those where Article 2 of the ECHR was engaged, concerning a death in custody, where the issuance of a Preventing Future Deaths report was considered and in cases where overlapping issues of public law and criminal law had arisen.Andrew has also undertaken research for other members of Chambers on the development and scope of the “interested persons” provisions, into the coroner’s powers to impose reporting restrictions and on applications under section 13 of the Coroner’s Act 1988 to re-open a concluded inquest.
Andrew is familiar with public inquiries having spent a year as a paralegal in the legal team of UK Government Investments where he assisted with a major public inquiry and understands well inquiry procedures from the perspective of an institutional core participant.
