Elizabeth Gallagher specialises in personal injury law and related areas.
She is an experienced and confident advocate, who represents both claimants and defendants at trial and in the full range of interim hearings (including applications and costs and case managements hearings). She also has a busy paperwork practice, advising on liability, quantum, evidence and procedure, as well as drafting pleadings and schedules of loss.
Elizabeth prides herself on her personable manner and her ability to give clear, client-focused advice. She is adept at representing clients who require additional support and guidance for whatever reason, including individuals with literacy difficulties and children/young people.
She is familiar with dealing with sensitive, high-profile matters, having been instructed in the Hillsborough Victims Litigation and being currently instructed on the Grenfell Tower Inquiry.
Elizabeth is the Assistant Editor of the TGC Personal Injury newsletter. In 2022, she was appointed a Deputy District Judge on the South Eastern Circuit.
Elizabeth accepts instructions on behalf of both claimants and defendants. She has experience encompassing a wide range of areas of personal injury law, including employers’ liability; occupiers’ liability; highway accidents; road traffic accidents; product liability; landlord’s liability for defective premises and travel claims. She also has experience of group litigation.
Elizabeth is able to advise on all aspects of litigation – including limitation, liability, evidence and quantum, either at conference or in writing. Her preference, where possible, is to be instructed early in the proceedings. She is also appears in applications involving procedural issues such as relief from sanctions, costs arguments and limitation.
She is regularly instructed in multi-track cases and is confident dealing with expert medical evidence across a range of fields. She is experienced at dealing with (amongst others) serious orthopaedic injuries including amputations, burn injuries and serious scarring, long-term psychiatric disorders and pain conditions.
She is willing to accept instructions on a conditional fee basis in appropriate cases. She is also willing to travel for in-person conferences with clients.
Elizabeth has extensive trial experience in relation to personal injury claims involving issues of causation (including low velocity impact claims), occupancy, induced and/or staged road traffic collisions. She also has experience of cases involving exaggerated or fabricated injuries using surveillance and social media evidence.
She also routinely advises clients in conference in relation to allegations of fraud made by or against them. She understands the significance of findings of fundamental dishonesty and/or under Section 57 to both claimants and defendants, and can be relied upon to give robust and realistic advice. When representing claimants, she always takes care to explain the issues in terms that can be easily understood by non-lawyers.
Elizabeth is currently instructed on the Grenfell Tower Inquiry on behalf of Rydon Maintenance Limited.
Her experience in this field (for example, in relation to inquests arising out of road traffic accidents) also dovetails with her personal injury practice and she able to advise on any connected civil proceedings which may arise following a death.
She is experienced in dealing with matters that involve 1000s of pages of documentary evidence and a detailed chronology.
Elizabeth regularly represents claimants and defendants at costs and case management conferences (CCMC). She can advise on costs budgeting prior to the CCMC where that would be of assistance.
She is also able to advise in conference or in writing on issues arising out of QOCS, Part 36, non-party costs orders and the application of the fixed costs regime.
She accepts instructions for detailed assessments of inter-partes costs. She also has experience of solicitor/client disputes and proceedings for wasted costs orders against legal representatives.
Elizabeth is experienced with health and safety issues arising out of her personal injury practice, including claims on construction sites and in other employment settings, and her work on the Grenfell Tower Inquiry.
Elizabeth has a broad insurance practice and is regularly instructed on behalf of national insurance companies as well as a number of international insurers. She has particular experience of issues arising from misrepresentation and non-disclosure in the context of motor insurance, and indemnity disputes in relation to the Road Traffic Act 1988 and Article 75 of the Motor Insurers’ Bureau’s Articles of Association.
