Richard Boyle has expertise across the range of Chambers’ work. He practises private and public law and was appointed to the Attorney General’s B panel in 2022, following four years on the C panel.
He regularly appears in civil proceedings, inquests, inquiries, costs proceedings, the Upper Tribunal (Asylum & Immigration Chamber) and judicial review proceedings. He prides himself on being approachable, providing pragmatic advice and advocacy skills developed through a busy court practice.
Richard acts in all areas of personal injury work for both Claimants and Defendants. He is regularly instructed in high value multi-track claims in the County Court and the High Court. He is comfortable drafting and advising on such cases, as well as attending Joint Settlement Meetings. Richard is frequently in court and experienced in cross examination, particularly after extensive trial experience representing insurers in motor fraud cases where fraud and/or fundamental dishonesty have been alleged.
In addition to his private practice, Richard often acts in personal injury and clinical negligence claims involving the state. He has expertise in cases involving the military, including claims for failure to diagnose PTSD, near-freezing cold injuries, negligent prescription of lariam, bullying & harassment claims and injuries sustained in military camps, such as Camp Bastion. Richard has represented the Ministry of Defence as sole counsel in a cohort of claims relating to PTSD suffered during military service. He also receives instructions involving prisons, including prisoner-on-prisoner assaults and assaults on prison staff.
Richard is often instructed in high-profile and complex inquests by government departments, private companies and bereaved families. He acted on behalf of HM Government, in particular the Home Office and the Ministry of Justice, in a series of well publicised cases arising out of terror attacks: the Fishmongers’ Hall inquests, the Manchester Arena Inquiry, the inquest into the death of Sudesh Amman (who died during a terror attack on Streatham High Road) and the Dawn Sturgess Inquiry. He is instructed as counsel to the inquest in the inquests arising out of the terror attack in Forbury Gardens, Reading. Richard was junior to Nicholas Moss KC in the inquest into the death of Geoff Gray, the third death at Deepcut barracks.
Richard regularly acts in inquests arising out of deaths in prison, including deaths related to drugs detoxification, new psychoactive substances and self harm. He also has experience of inquests related to RTAs, health and safety, accidents at work and the police. Richard advises the Ministry of Justice’s Coroners, Burials, Cremation and Inquiries Policy Team.
Richard often acts in clinical negligence claims involving the state. He has expertise in cases involving the military, including claims for failure to diagnose PTSD, near-freezing cold injuries and negligent prescription of lariam.
Richard frequently receives instructions to advise and appear in specialist costs proceedings, such as solicitor and client assessments. He has acted in numerous CCMCs and detailed assessments. He was instructed by the Lord Chancellor to appear in the High Court in costs proceedings (Fuseon Ltd v Senior Courts Costs Office & the Lord Chancellor [2019] EWHC 126 (Admin)). Richard has particular expertise in claims involving the recovery of ATE premiums. He is an editor of the TGC Costs Newsletter and was a contributor to Greenslade on Costs.
Richard acts in the fields of military law, police law, prison law and national security. He has acted in a number of public law claims brought against the Ministry of Justice relating to prisoners, including a group action for claimed breaches of the Human Rights Act based on prison conditions.
Richard spent time on secondment with the Independent Police Complaints Commission (now the Independent Office for Police Conduct). He represented the IPCC in judicial review proceedings and inquests, as well as working on the investigations into the deaths of Mark Duggan, Bijan Ebrahimi and Sean Rigg. He is on the IOPC’s counsel panel and also receives instructions from police forces.
Immigration
Richard practises in all areas of immigration law. As well as the First-tier and Upper Tribunals, he has acted on cases in the High Court and the Court of Appeal. He has acted on a number of cases with a national security element, including cases in SIAC and involving applications under s.6 of the Justice and Security Act 2013. He regularly advises on unlawful detention claims.
Richard was led by Keith Morton KC in a large prosecution against a leading construction company. The case concerned the company’s management of hand arm vibration (HAVs) over a nine year period. He has appeared in a number of plea and case management hearings.
