High Court application exploring provisions of CPR 32.5(3) permitting an existing witness to amplify her evidence with a further witness statement served out of time before trial

Permission was granted for M to rely on parts of a third witness statement which would allow her to rebut allegations of fundamental dishonesty in her personal injury claim against her employer. Permission for her to rely on witness statements from seven new witnesses was refused where the benefit the statements brought was significantly outweighed by the delay to the trial and the materiality of other evidence that spoke to the same issues.
