In the modern world, defective products litigation presents an enormous challenge for both claimants and defendants alike.
For claimants, against a backdrop of often catastrophic injury, property damage or business interruption pursuing a claim relating to a defective product can be daunting, slow and expensive. For manufacturers, producers and retailers the task of investigating claims can be both complex and give rise to important commercial and reputational issues.
Chambers has a strong reputation for product liability work with a range of barristers at all levels of seniority who can provide assistance in relation to such products disputes. Members act for claimants and defendants/insurers. We believe this ensures that our barristers can provide advice and representation of the highest quality which is both independent and objective. Additionally, it enables them to advise and represent their clients which takes account of the commercial and reputational sensitivities.
Members have extensive experience of dealing with product liability disputes by way of alternative dispute resolution including, but not limited to, via arbitration and mediation. In so doing members have helped to facilitate sensible, efficient and cost effective settlement in a large number of often complex cases.
We have individual members of chambers who have experience of product liability litigation in respect of a wide range of products/sectors including: aviation, automotive (including relating to motor vehicles and motorcycles), sports equipment including bicycles and climbing gear, domestic white goods and other appliances, industrial equipment, medical equipment and implants, tobacco and foodstuffs. Members have particular experience in explosion, fire and flood claims.
Members’ bring to bear their related expertise in personal injury, clinical negligence, health & safety and inquests in the multiplicity of different claims to which defective products can and do give rise. Members also provide advice on insurance coverage disputes which can and often do arise in connection with product liability litigation. Members can provide advice and representations in cases involving Group Litigation Orders (collective redress). Members also provide advice on regulatory compliance issues with respect to products including product recalls and safety campaigns (e.g. under the General Product Safety Regulations 2005).
