High Court FAA claim. Lionel Stride (instructed by Adrian Cottam and Emma Yeomans of DAC Beachcroft) represented the Defendant in a complex case arising out of a pedestrian accident. The main issues related to whether R, the partner of the Deceased, was a qualifying cohabitee given the recency of their relationship; and, if not, how their daughter’s dependency should be calculated given R’s high income. The case was pleaded at over £4million and settled for a low seven figure sum at a JSM after exchange of detailed position statements on the legal arguments. The settlement, later approved by Master Sullivan, reflected the significant risk that the claimant would lose the cohabitation argument and be left with a zero award.
