Instructed on behalf of the Home Office in this unfair dismissal and age discrimination claim, heard over five days.

The Claimant was an Immigration Liaison Officer based overseas. Dismissing all claims (and having struck out the race discrimination claim at a preliminary hearing) the Tribunal held that:

1. Not extending the Claimant’s posting abroad did not amount to a repudiatory breach of his contract;
2. The refusal of the Claimant’s extension request was not discriminatory; and
3. The Claimant’s claim of age discrimination arising from his employment pre-resignation was not made out.
