Sacha Ackland appeared on behalf of Milton Keynes Council (instructed by John Palmer of DWF London) at the liability trial of a claim arising from an accident during a school production of ‘Grease’.
The Claimant suffered a serious knee injury when he jumped off the car prop in the course of a dance scene in rehearsal. A claim was brought alleging negligence in relation to the construction and maintenance of the stage and car prop, and also the choreography of the dance scene. Evidence was heard from the Claimant and a supporting witness; and from teachers and support staff at the school. After hearing submissions Her Honour Judge Clarke (sitting at Oxford) dismissed the claim on the basis the Claimant had failed to establish negligence in any of the areas pleaded.
