African Court on Human and Peoples’ Rights rules that Saif Gaddafi’s trial is unfair

Rodney Dixon QC with Aidan Ellis have been acting for Dr Mishana Hosseinioun who petitioned the African Commission and Court on behalf of Mr. Gaddafi.

The Court, sitting in Arusha, Tanzania, found that Libya had not respected any of the constituent elements of the right to a fair hearing at Mr. Gaddafi’s trial in Tripoli, Libya, and in sentencing him to death without ever allowing him access to a lawyer of his choosing or even to attend the hearings. The Court also held that Libya’s prolonged incommunicado detention of Mr Gaddafi at an unknown location violated his right to liberty. Libya have been given 60 days to respond to and implement the Court’s decision.
