Court of Appeal clarifies test for referrals to an Independent Adjudicator

The Court of Appeal, in allowing the Secretary of State’s appeal against the decision of the High Court, held that an Independent Adjudicator was not under a duty to enquire into the thought processes or the reasoning of the Governor as to whether the charge met the threshold of being “so serious that additional days should be awarded for the offence if the prisoner is found guilty.
