Rodney Dixon KC and Kathryn Howarth file an Article 15 Communication with the Prosecutor at the International Criminal Court in relation to alleged Crimes against humanity in Tunisia

Rodney Dixon KC and Kathryn Howarth have filed an Article 15 Communication at the International Criminal Court, requesting that the Prosecutor open an investigation into alleged Crimes against humanity in Tunisia.

Since what has been described as a “coup” by President Kais Saeid on 25 July 2021, there has been significant repression of freedom of expression and assembly in Tunisia. From the start of 2023, in a crack down on opposition to President Saied’s regime, there have been a series of high profile arrests of Tunisian opposition voices, including MPs, members of the judiciary, lawyers and journalists. Laws curtailing freedom of expression and assembly have also affected civil society and the wider civilian population. Further, since a speech made by the President in February this year, black African migrants in Tunisia have been subjected to persecution and human rights violations. These include reported compulsory expulsions to the desert border areas with Algeria and Libya, undertaken by the Tunisian Army and the National Guard.

Tunisia is a Member State of the ICC and the alleged violations come within the Court’s jurisdicition. The Prosecutor has been requested to open an investigation into the alleged criminal responsibility of the President and other senior officials in Tunisia.
